Contract Indemnification Language | 5/11/10 11:43 AM

I am seeing more and more Sponsors coming out with very strong cross indemnification clauses in their contracts. We will not sign these agreements as we are not an insurance company and cannot indemnify. It has become a daunting tadk to get the wording in the contract we can accept. In fact there is one major Sponsor we can't work with because of the contract. I would like to discuss how others are handling this issue.

We have been seeing the same thing (see my post from several months ago). I've always been told not to indemnify a sponsor or CRO. Yet I've heard from at least one CRO and one major sponsor that the language is required and non-negotiable.
